                        "data": "This is a big question, but the story about Katerra I’ve "
                    },

                        "data": "written for Florida Construction News should cause you to "
                    },

                        "data": "think about the implications of how things will change "
                    },

                        "data": "when big technology capital connects with the AEC indus- "
                    },
                    {
                        "data": "try. If things go as expected, there will be a fundamental "
                    },
                    {
                        "data": "shake-down in many aspects of our industry. "
                    },

                        "data": "Is all of this hype, perhaps to promote a specific com- "
                    },

                        "data": "pany? I think not. While the publishing industry has many "
                    },
                    {
                        "data": "differences from the construction world, it has suffered in- "
                    },
                    {
                        "data": "credible dislocation. Most traditional mainstream media "
                    },
                    {
                        "data": "businesses have yet to resolve and adapt successfully to "
                    },
                    {
                        "data": "the changes from print and conventional broadcast to pri- "
                    },
                    {
                        "data": "marily online and social media models. (We’ve made the "
                    },
                    {
                        "data": "transition from a primarily print to primarily digital business "
                    },
                    {
                        "data": "and I’m learning more every day – but the pace of market "
                    },
                    {
                        "data": "change is so intense it is almost overwhelming.) "
                    },
                    {
                        "data": "Katerra, after all, may have the early lead in the technol- "
                    },
                    {
                        "data": "ogy/AEC contracting space, but I’m sure other new com- "
                    },
                    {
                        "data": "petitors will arise, and well-established builders, suppliers, "
                    },
                    {
                        "data": "and consultants will adapt their business to the new frame- "
                    },
                    {
                        "data": "work and decision-making processes. "
                    },
                    {
                        "data": "Just be aware: Huge changes are likely in the way we "
                    },
                    {
                        "data": "operate our businesses, and the changes may be coming "
                    },

                        "data": "much more quickly than we could have even imagined just "
                    },

                    },

                        "data": "be both effective and dysfunctional "
                    },
                    {
                        "data": "(depending on the circumstances) "
                    },
                    {
                        "data": "when Hurricane Irma blew through "
                    },
                    {
                        "data": "Florida last September? "
                    },
                    {
                        "data": "The answer varies, especially for "
                    },
                    {
                        "data": "the hot-button area of backup power "
                    },
                    {
                        "data": "requirements for nursing homes and "
                    },
                    {
                        "data": "assisted care facilities – as lawyers "
                    },
                    {
                        "data": "and lobbyists take their cases to the "
                    },
                    {
                        "data": "courts and the Florida legislature. "
                    },
                    {
                        "data": "One estimate puts the cost at $230 "
                    },
                    {
                        "data": "million – but who will pay, and when, "
                    },
                    {
                        "data": "has been a hot-button controversy. "
                    },
                    {
                        "data": "By January, much of the issue had "
                    },
                    {
                        "data": "been resolved when Gov. Rick Scott "
                    },
                    {
                        "data": "modified proposed regulations that "
                    },
                    {
                        "data": "caused nursing home operators to "
                    },
                    {
                        "data": "take their objections to the original "
                    },
                    {
                        "data": "proposals to court. However, there "
                    },
                    {
                        "data": "still are questions about the timeline "
                    },
                    {
                        "data": "and overall cost/scale of implementa- "
                    },
                    {
                        "data": "tion of the backup power provisions. "
                    },
                    {
                        "data": "This story started more than a "
                    },
                    {
                        "data": "decade ago, after Hurricane Wilma in "
                    },
                    {
                        "data": "2005. Legislation implemented then "
                    },
                    {
                        "data": "required gas stations to have backup "
                    },
                    {
                        "data": "power to keep the lights on and "
                    },
                    {
                        "data": "pumps running after a natural disas- "
                    },
                    {
                        "data": "ter. The original legislation passed in "
                    },
                    {
                        "data": "2006 also would have required all "
                    },
                    {
                        "data": "nursing homes to install generators "
                    },
                    {
                        "data": "capable of cooling and running their "
                    },
                    {
                        "data": "facilities. “That went nowhere as the "
                    },
                    {
                        "data": "powerful long-term care industry ob- "
                    },
                    {
                        "data": "jected to the price tag,” the Miami "
                    },
                    {
                        "data": "Herald has reported. "
                    },
                    {
                        "data": "The generators worked as planned "
                    },
                    {
                        "data": "in 2017 for the gas stations and re- "
                    },
                    {
                        "data": "lated convenience stores, but when "
                    },
                    {
                        "data": "Hurricane Irma hit, some assisted "
                    },
                    {
                        "data": "care facilities were caught in a bind, "
                    },
                    {
                        "data": "and eight people died in a Broward "
                    },
                    {
                        "data": "County nursing home left without "
                    },
                    {

                        "data": "The Rehabilitation Center at Hollywood "
                    },
                    {
                        "data": "Hills, where eight people died when tem- "
                    },
                    {
                        "data": "peratures soared without air conditioning "
                    },
                    {
                        "data": "after Hurricane Irma last September. "
                    },
                    {
                        "data": "While that nursing home and oth- "
                    },
                    {
                        "data": "ers had limited backup power allow- "
                    },
                    {
                        "data": "ing them to maintain lights and some "
                    },
                    {
                        "data": "medical equipment, they were un- "
                    },
                    {
                        "data": "equipped for the higher air condition- "
                    },
                    {
                        "data": "ing power demands. "
                    },
                    {
                        "data": "After the storm, Gov. Rick Scott di- "
                    },
                    {
                        "data": "rected two state agencies to demand "
                    },
                    {
                        "data": "that nursing homes and assisted liv- "
                    },
                    {
                        "data": "ing facilities quickly add generators "
                    },
                    {
                        "data": "and fuel to maintain safe tempera- "
                    },
                    {
                        "data": "tures – and they were given a Nov. 15 "
                    },
                    {
                        "data": "deadline. However, in late October a judge "
                    },
                    {
                        "data": "accepted industry objections to the "
                    },
                    {
                        "data": "deadline, and overturned the regula- "
                    },
                    {
                        "data": "tions. The Florida Health Care Associa- "
                    },
                    {
                        "data": "tion (FHCA), representing nursing "
                    },
                    {
                        "data": "home operators, estimates it will cost "
                    },
                    {
                        "data": "about $230 million for more than 650 "
                    },
                    {
                        "data": "nursing homes to get the higher "
                    },
                    {
                        "data": "powered generators needed to keep "
                    },
                    {
                        "data": "temperatures at 81 degrees or under "
                    },
                    {
                        "data": "for four days following a storm. "
                    },
                    {
                        "data": "The industry says it needed more "
                    },
                    {
                        "data": "time – and wanted public money – to "
                    },
                    {
                        "data": "help pay the cost. "
                    },
                    {
                        "data": "There is some deja vu here, relat- "
                    },
                    {
                        "data": "ing to the 2006 arguments and fund- "
                    },
                    {
                        "data": "ing battles. "
                    },
                    {
                        "data": "There, the nursing homes fought – "
                    },
                    {
                        "data": "and won – the argument that they "
                    },
                    {
                        "data": "didn’t need the generators, as long as "
                    },
                    {
                        "data": "they had evacuation plans in place. "
                    },
                    {
                        "data": "The argument was that if nursing "
                    },
                    {
                        "data": "homes installed generators and "
                    },
                    {
                        "data": "would receive patients evacuated "
                    },
                    {
                        "data": "from other locations, they should be "
                    },
                    {
                        "data": "able to receive some government "
                    },
                    {
                        "data": "subsidies for the generator installa- "
                    },
                    {
                        "data": "tion costs. However, the funds never "
                    },
                    {
                        "data": "materialized, and most nursing "
                    },
                    {
                        "data": "homes continued with limited gener- "
                    },
                    {
                        "data": "ator power. "
                    },
                    {
                        "data": "Unfortunately, the option for evac- "
                    },
                    {
                        "data": "uation to other nursing homes didn’t "
                    },
                    {
                        "data": "work when Hurricane Irma’s course "
                    },
                    {
                        "data": "shifted and residents who had been "
                    },
                    {
                        "data": "evacuated from one home found "
                    },
                    {
                        "data": "themselves stranded in another loca- "
                    },
                    {
                        "data": "tion, that also needed to be evacu- "
                    },
                    {
                        "data": "ated. Back in 2006, gas station opera- "
                    },
                    {
                        "data": "tors on evacuation routes didn’t put "
                    },
                    {
                        "data": "up a fight against the generator legis- "
                    },
                    {
                        "data": "lation, even though they apparently "
                    },
                    {
                        "data": "didn’t receive any subsidies for the "
                    },
                    {
                        "data": "systems, which could have cost "
                    },
                    {
                        "data": "$45,000 each (in 2007 dollars) to in- "
                    },
                    {
                        "data": "stall. In fact, they helped craft the leg- "
                    },
                    {
                        "data": "islation. “Members have a responsibility to "
                    },
                    {
                        "data": "their communities and part of that re- "
                    },
                    {
                        "data": "sponsibility is to comply with the "
                    },
                    {
                        "data": "law,” Jim Smith, then president and "
                    },
                    {
                        "data": "chief executive of the Florida Petro- "
                    },
                    {
                        "data": "leum Marketers and Convenience "
                    },
                    {
                        "data": "Store Association, said in a published "
                    },
                    {
                        "data": "interview. Rules set out guidelines for "
                    },
                    {
                        "data": "the generator requirement based on "
                    },
                    {
                        "data": "the number of pumps, and the popu- "
                    },
                    {
                        "data": "lation of the area the gas stations "
                    },
                    {
                        "data": "served. While they could use "
                    },
                    {
                        "data": "portable generators, there was also a "
                    },
                    {
                        "data": "requirement for proper “transfer "
                    },
                    {
                        "data": "switches” to ensure the plug-in gen- "
                    },
                    {
                        "data": "erators would operate safely when in- "
                    },
                    {
                        "data": "stalled. The assisted care/nursing story is "
                    },
                    {
                        "data": "different. Industry lobbyists argued "
                    },
                    {
                        "data": "the attempt to require generators to "
                    },
                    {
                        "data": ""
                    }

                        "data": "nursing homes” and assisted living "
                    },

                        "data": "facilities to comply with the orders by "
                    },
                    {
                        "data": "the deadline. "
                    },
                    {
                        "data": "Gov. Scott initially said he would "
                    },
                    {
                        "data": "appeal the decision, and a "
                    },
                    {
                        "data": "spokesman for the governor said the "
                    },
                    {
                        "data": "administration will continue to work "
                    },
                    {
                        "data": "with the legislature to make the gen- "
                    },
                    {
                        "data": "erator rules permanent. "
                    },
                    {
                        "data": "The FHCA has asked that Medi- "
                    },
                    {
                        "data": "caid, which covers about 60 percent "
                    },
                    {
                        "data": "of the nursing home days – to cover "
                    },
                    {
                        "data": "a corresponding amount of the costs. "
                    },
                    {
                        "data": "This would result in a cost to the "
                    },
                    {
                        "data": "state of $53.8 million. Federal match- "
                    },
                    {
                        "data": "ing dollars would absorb another "
                    },
                    {
                        "data": "$84.1 million. "
                    },
                    {

                    },

                        "data": "tion was passed in 1986. Since then, "
                    },
                    {
                        "data": "the tax rules – Internal Revenue Code "
                    },
                    {
                        "data": "amendments, regulations, proce- "
                    },
                    {
                        "data": "dural guidance and court case law – "
                    },
                    {
                        "data": "have morphed into a complex sys- "
                    },
                    {
                        "data": "tem for tax paying contractors. The "
                    },
                    {
                        "data": "recently signed bill is a significant "
                    },
                    {
                        "data": "modification to the existing system "
                    },
                    {
                        "data": "and the consensus is clear. Most "
                    },
                    {
                        "data": "businesses expect their income tax "
                    },
                    {
                        "data": "expense to decrease, including con- "
                    },
                    {
                        "data": "tractors. Though there are many moving "
                    },
                    {
                        "data": "parts in the new tax law with the po- "
                    },
                    {
                        "data": "tential to affect businesses and indi- "
                    },
                    {
                        "data": "viduals to varying degrees, this "
                    },
                    {
                        "data": "article highlights what we consider "
                    },
                    {
                        "data": "10 of the most significant changes "
                    },
                    {
                        "data": "for construction companies. "
                    },
                    {
                        "data": "1. Individual tax rates and "
                    },
                    {
                        "data": "corporate tax rates "
                    },
                    {
                        "data": "The final bill settled on keeping "
                    },
                    {
                        "data": "the same number of individual tax "
                    },
                    {
                        "data": "brackets as in current existence: "
                    },
                    {
                        "data": "seven. However, the new tax law re- "
                    },
                    {
                        "data": "duces individual income tax rates to "
                    },
                    {
                        "data": "10, 12, 22, 24, 32, 35 and 37 percent, "
                    },

                        "data": "and raises the income levels subject "
                    },

                    },

                        "data": "Under prior tax law, contractors "
                    },

                        "data": "whose average annual gross receipts "
                    },

                        "data": "were less than $10 million were ex- "
                    },
                    {
                        "data": "empt from using the percentage of "
                    },
                    {
                        "data": "completion (PCM) method of ac- "
                    },
                    {
                        "data": "counting for income tax purposes. "
                    },
                    {
                        "data": "Under the new bill, the average an- "
                    },
                    {
                        "data": "nual gross receipts requirement has "
                    },
                    {
                        "data": "been increased to $25 million. This is "
                    },
                    {
                        "data": "effective for any contracts entered "
                    },
                    {
                        "data": "into after Dec. 31, 2017. It is impor- "
                    },
                    {
                        "data": "tant to note that for commercial con- "
                    },
                    {
                        "data": "tracts, percentage of completion is "
                    },
                    {
                        "data": "still required to be used for purposes "
                    },
                    {
                        "data": "of the alternative minimum tax "
                    },
                    {
                        "data": "(AMT). While under the final bill AMT was "
                    },
                    {
                        "data": "repealed for businesses taxed as a "
                    },
                    {
                        "data": "‘C’ corporation, it was not repealed "
                    },
                    {
                        "data": "for individuals. However, it did pro- "
                    },
                    {
                        "data": "vide for increased individual exemp- "
                    },
                    {
                        "data": "tions. The 2018 exemption amount "
                    },
                    {
                        "data": "was increased from $86,200 to "
                    },
                    {
                        "data": "$109,400 and the phase out thresh- "
                    },
                    {
                        "data": "old increased from $164,100 to $1 "
                    },
                    {
                        "data": "million for married filing joint taxpay- "
                    },
                    {
                        "data": "ers. The exemption amount for sin- "
                    },
                    {
                        "data": "gle taxpayers increased from "
                    },
                    {
                        "data": "$55,400 to $70,300 and the phase "
                    },
                    {
                        "data": "out threshold increased from "
                    },
                    {
                        "data": "$123,500 to $500,000. "
                    },
                    {
                        "data": "Contractors, other than ‘C’ corpo- "
                    },
                    {
                        "data": "rations, considering making the "
                    },
                    {
                        "data": "switch to a method other than PCM "
                    },
                    {
                        "data": "for 2018, will want to consider the "
                    },
                    {
                        "data": "potential for AMT impacts before "
                    },
                    {
                        "data": "making a final decision. If a contrac- "
                    },
                    {
                        "data": "tor switches to a method other than "
                    },
                    {
                        "data": "PCM for 2018, any contracts entered "
                    },
                    {
                        "data": "into before Dec. 31, 2017, would be "
                    },
                    {
                        "data": "taxed under the prior method of ac- "
                    },
                    {
                        "data": "counting even if the contract contin- "
                    },
                    {
                        "data": "ued into 2018. "
                    },
                    {
                        "data": "3. Pass-through income deduction "
                    },
                    {
                        "data": "Aligning with a reduced corporate "
                    },
                    {
                        "data": "tax rate, Congress provided pass- "
                    },
                    {
                        "data": "through entities with a deduction for "
                    },
                    {
                        "data": "a percentage of their taxable income. "
                    },
                    {
                        "data": "Starting in 2018, a deduction will be "
                    },
                    {
                        "data": "allowed for taxpayers who have qual- "
                    },
                    {
                        "data": "ified business income (QBI) from a "
                    },
                    {
                        "data": "partnership, ‘S’ corporation, or sole "
                    },
                    {
                        "data": "proprietorship, subject to limitations. "
                    },
                    {
                        "data": "The 20 percent deduction is limited "
                    },
                    {
                        "data": "to the lesser of (1) 20 percent of their "
                    },
                    {
                        "data": "pass-through business income or (2) "
                    },
                    {
                        "data": "the greater of (a) 50 percent of the "
                    },
                    {
                        "data": "W-2 wages paid in the qualified trade "
                    },
                    {
                        "data": "or business, or (b) the sum of 25 per- "
                    },

                        "data": "cent of W-2 wages, plus 2.5 percent "
