                    },

                        "data": "ect in its news release, but Florida regulators on Jan. 5 ap- "
                    },

                        "data": "proved the 1,600-Mw Okeechobee Clean Energy Center of "
                    },
                    {
                        "data": "NextEra Energy subsidiary Florida Power & Light (FPL) near "
                    },
                    {
                        "data": "Vero Beach. "
                    },
                    {
                        "data": "The plant will be the fifth advanced combined cycle "
                    },
                    {
                        "data": "power plant FPL has commissioned since 2009, power- "
                    },
                    {
                        "data": "mag.com reports. "
                    },

                        "data": "FPL says the facility will create an average of approxi- "
                    },

                        "data": "mately 300 jobs during the two-year construction period – "

                    },

                        "data": "The Dodge Momentum Index rose 1.6 percent in Febru- "
                    },
                    {
                        "data": "ary to 144.0 (2000=100) from its revised January reading "
                    },
                    {
                        "data": "of 141.7. The Momentum Index is a monthly measure of "
                    },
                    {
                        "data": "the first (or initial) report for nonresidential building projects "
                    },
                    {
                        "data": "in planning, which have been shown to lead construction "
                    },
                    {
                        "data": "spending for nonresidential buildings by a full year. "
                    },
                    {
                        "data": "February’s increase was due to a 4.4 percent jump in in- "
                    },
                    {
                        "data": "stitutional planning, while commercial planning slipped "
                    },
                    {
                        "data": "slightly, falling 0.3 percent for the month. "
                    },

                        "data": "The Momentum Index has now increased for five con- "
                    },

                    },

                        "data": "On a year over year basis the Momentum Index is 22 "

                        "data": "percent higher, with commercial planning up 28 percent "

                    },

                        "data": "The statute “bars unfiled lawsuits "
                    },

                        "data": "passage of 10 years,” they write. "
                    },

                        "data": "10 years after the last of four specified "
                    },

                        "data": "events to occur that construction re- "
                    },
                    {
                        "data": "lated liability ceases. In Florida, the 10- "
                    },
                    {
                        "data": "year deadline begins to run from the "
                    },
                    {
                        "data": "last date of the following: actual pos- "
                    },
                    {
                        "data": "session by the owner, issuance of a "
                    },
                    {
                        "data": "certificate of occupancy, date of aban- "
                    },
                    {
                        "data": "donment of construction, or the date "
                    },
                    {
                        "data": "of completion or termination of the "
                    },
                    {
                        "data": "contract between the engineer, archi- "
                    },
                    {
                        "data": "tect and licensed contractor with the "
                    },
                    {
                        "data": "owner.” They write that the loophole the "
                    },
                    {
                        "data": "bills would close is in the fourth trig- "
                    },
                    {
                        "data": "ger: completion of the contract. "
                    },
                    {
                        "data": "“Florida courts have wrestled with "
                    },
                    {
                        "data": "the question of what does ‘comple- "
                    },
                    {
                        "data": "tion or termination of the contract’ "
                    },
                    {
                        "data": "mean and, if completion of the con- "
                    },
                    {
                        "data": "tract is the last of the four triggers to "
                    },
                    {
                        "data": "occur, from what date the 10-year win- "
                    },
                    {
                        "data": "dow is measured.” "
                    },
                    {

                        "data": "Florida’s Fifth District Court of Ap- "
                    },

                        "data": "peal weighed in on this issue in 2015, "
                    },
                    {
                        "data": "the lawyers say. “In Cypress Fairway "
                    },
                    {
                        "data": "Condominium v. Bergeron Construc- "
                    },
                    {
                        "data": "tion, the court held that ‘contract com- "
                    },
                    {
                        "data": "pletion’ was the date on which final "
                    },
                    {
                        "data": "payment was made rather than when "
                    },
                    {
                        "data": "the work under the contract was com- "
                    },
                    {
                        "data": "pleted.” This distinction is critical as con- "
                    },
                    {
                        "data": "struction can be completed long be- "
                    },
                    {
                        "data": "fore final payment is made. It further "
                    },
                    {
                        "data": "poses concerns if final payment on "
                    },
                    {
                        "data": "the contract is never made or is not "
                    },
                    {
                        "data": "made in full. "
                    },
                    {
                        "data": "“Because this issue has not been "
                    },
                    {
                        "data": "directly addressed by Florida courts, it "
                    },
                    {
                        "data": "leaves an open question about "
                    },
                    {
                        "data": "whether or when the statute of repose "
                    },
                    {
                        "data": "begins to run. In the Cypress Fairways "
                    },
                    {
                        "data": "case, had the statute of repose been "
                    },
                    {
                        "data": "tied to completion of construction "
                    },
                    {
                        "data": "rather than final payment, the lawsuit "
                    },
                    {
                        "data": "would have been barred. Instead, the "
                    },
                    {
                        "data": "developers, planners, designers and "
                    },
                    {
                        "data": "contractors found themselves in the "
                    },
                    {
                        "data": "unenviable position of defending "
                    },
                    {
                        "data": "against construction defect claims in- "
                    },
                    {
                        "data": "volving a project more than 10 years "
                    },
                    {
                        "data": "old.” “The new legislation was, in large "
                    },
                    {
                        "data": "part, introduced in response to the Cy- "
                    },
                    {
                        "data": "press Fairways court’s holding; to "
                    },
                    {
                        "data": "now tie up the “completion of con- "
                    },
                    {
                        "data": "tract” loose end by linking it to com- "
                    },
                    {
                        "data": "pletion of contract work (not including "
                    },
                    {
                        "data": "punch list work) rather than receipt of "
                    },
                    {
                        "data": "final payment,” they write. "
                    },
                    {
                        "data": "“Completion of the contract would "
                    },
                    {
                        "data": "be defined as: ‘Completion of the con- "
                    },
                    {
                        "data": "tract means the latter of the date of "
                    },
                    {
                        "data": "final performance of all the contracted "
                    },
                    {
                        "data": "services or the date that final payment "
                    },
                    {
                        "data": "for such services becomes due with- "
                    },
                    {
                        "data": "out regard to the date final payment is "
                    },
                    {
                        "data": "made.’ Both bills seek to provide clar- "
                    },
                    {
                        "data": "ity as to what ‘completion of the con- "
                    },
                    {
                        "data": "tract’ means and could have a large "
                    },
                    {
                        "data": "effect on how courts interpret com- "
                    },
                    {
                        "data": "pletion when applying the statute of "
                    },
                    {
                        "data": "repose to cases involving old con- "
                    },
                    {
                        "data": "struction.” While the bills will define what "
                    },
                    {
                        "data": "completion of the contract means, if "
                    },
                    {
                        "data": "it does not pass, planners, engineers, "
                    },
                    {
                        "data": "architects and contractors should take "
                    },
                    {
                        "data": "certain steps to help protect them- "
                    },
                    {
                        "data": "selves. For one, payment deadlines "
                    },
                    {
                        "data": "should be included in contracts. For "
                    },
                    {
                        "data": "example, a contract could include a "
                    },
                    {
                        "data": "term that specifies the owner must "
                    },
                    {
                        "data": "make payment within 20 days of a "
                    },
                    {
                        "data": "final payment application, regardless "
                    },
                    {
                        "data": "of punch list items remaining. If pay- "
                    },
                    {
                        "data": "ment is not made within 20 days or it "
                    },
                    {
                        "data": "is not full payment, the contract might "
                    },
                    {
                        "data": "still be deemed complete, just that the "
                    },
                    {
                        "data": "owner breached it. "
                    },
                    {
                        "data": "“The owner should not be permit- "
                    },
                    {
                        "data": "ted to prevent the statute of repose "
                    },
                    {
                        "data": "from beginning by not making timely "
                    },
                    {
                        "data": "or full payment. Otherwise, construc- "
                    },
                    {
                        "data": "tion related liability could be open- "
                    },
                    {
                        "data": "ended.” Other legislative attempts involving "
                    },
                    {
                        "data": "the statute of repose have failed in re- "
                    },
                    {
                        "data": "cent years, including an effort to re- "
                    },
                    {

                        "data": "the ins and outs of the industry explained, or the process "
                    },
                    {
                        "data": "involved, because I’ve actually done it.” "
                    },

                        "data": "Building his firm, which he formed in 2012 and that now "
                    },

                        "data": "has 12 attorneys, he sought the same kind of expertise and "
                    },

                        "data": "personal experience in his colleagues. He says each lawyer "

                    },

                    },

                    },

                    },

                    },

                        "data": "Approximately 3,000 operators "
                    },
                    {
                        "data": "have been certified in the last two "
                    },
                    {
                        "data": "years, Collins said. “That doesn’t nec- "
                    },
                    {
                        "data": "essarily mean that all of our members "
                    },
                    {
                        "data": "have certified operators, but clearly, "
                    },
                    {
                        "data": "we’re moving in that direction,” she "
                    },
                    {
                        "data": "says. ACPA members receive a signifi- "
                    },
                    {
                        "data": "cant certification fee reduction com- "
                    },
                    {
                        "data": "pared to non-member rates – from "
                    },
                    {
                        "data": "$225 to $60 per operator. "
                    },
                    {
                        "data": "The association also advocates for "
                    },
                    {
                        "data": "its members’ interests. There have "
                    },
                    {
                        "data": "been initiatives to revise taxation rules "
                    },
                    {
                        "data": "to make it fairer for concrete pump "
                    },
                    {
                        "data": "operators, including success in elimi- "
                    },
                    {
                        "data": "nating the retail excise tax on concrete "
                    },
                    {
                        "data": "pump chassis. "
                    },
                    {
                        "data": "“That was probably the biggest "
                    },
                    {
                        "data": "feather in our cap since I’ve been "
                    },
                    {
                        "data": "here,” Collins said in the interview. "
                    },
                    {
                        "data": "“The IRS wanted to change the classi- "
                    },
                    {
                        "data": "fication of concrete pumps from mo- "
                    },
                    {
                        "data": "bile machinery to ordinary over the "
                    },
                    {
                        "data": "road highway vehicles because in "
                    },
                    {
                        "data": "their opinion, a concrete pump chas- "
                    },
                    {
                        "data": "sis can be reconverted to a vehicle "
                    },
                    {
                        "data": "which can carry a load across the "
                    },
                    {
                        "data": "highway. Not only is this not possible, "
                    },
                    {
                        "data": "but clearly it’s just not feasible.” "
                    },
                    {
                        "data": "Removing the tax, for which mobile "
                    },
                    {
                        "data": "machinery is exempt, saves about "
                    },
                    {
                        "data": "$14,000 per chassis. The association "
                    },
                    {
                        "data": "also succeeded in ending the over the "
                    },
                    {
                        "data": "road use tax, averaging approximately "
                    },
                    {
                        "data": "$550 per vehicle. "
                    },
                    {
                        "data": "“It was several years of fighting "
                    },
                    {
                        "data": "back and forth, but last year, we were "
                    },
                    {
                        "data": "able to prevail, and by doing so saved "
                    },
                    {
                        "data": "our members million of dollars every "
                    },
                    {
                        "data": "year,” Collins said. "
                    },
                    {
                        "data": "The APCA has also initiated a pro- "
                    },
                    {
                        "data": "gram to establish benchmark con- "
                    },
                    {
                        "data": "crete pumping business financial "
                    },
                    {
                        "data": "data. Information from members’ fi- "
                    },
                    {
                        "data": "nancial statements, "
                    },
                    {
                        "data": "processed through a third party accountant, al- "
                    },
                    {
                        "data": "lows them to understand which oper- "
                    },
                    {
                        "data": "ations are most profitable and the "
                    },
                    {
                        "data": "typical expenses to expect, enabling "
                    },
                    {
                        "data": "the companies to see how they are "
                    },
                    {
                        "data": "performing and where they can im- "
                    },
                    {
                        "data": "prove. Collins is optimistic about the asso- "
                    },
                    {
                        "data": "ciation’s future. "
                    },
                    {
                        "data": "“(Our members are) very passion- "
                    },
                    {
                        "data": "ate about what they do,” she said. "

                        "data": "“They’re very involved. They are going "
                    },
                    {

                    },

                        "data": "years ago while I looked for my future "
                    },

                        "data": "career,” she said. “I started in the of- "

                        "data": "fice and have been here ever since.” "

                        "data": "Langhauser says the owner of the "
                    },

                        "data": "company at the time opened the "
                    },
                    {
                        "data": "doors to the business and future op- "
                    },

                        "data": "portunities. She says she began at- "
                    },
                    {
                        "data": "tending seminars, learning about the "
                    },
                    {
                        "data": "industry from jobsite to operations, "
                    },
                    {
                        "data": "and took classes to fill in what she "
                    },
                    {
                        "data": "needed to know. "
                    },
                    {
                        "data": "She says she was never treated "
                    },
                    {
                        "data": "poorly at any point in her career. How- "
                    },
                    {
                        "data": "ever, in her early years, she appreci- "
                    },
                    {
                        "data": "ated she was working in a male "
                    },
                    {
                        "data": "dominated field, where women were "
                    },
                    {
                        "data": "unexpected. “There has not been a significant "
                    },
                    {
                        "data": "change in this but where before I "
                    },
                    {
                        "data": "would attend a conference and be the "
                    },
                    {
                        "data": "only woman present, now there may "
                    },
                    {
                        "data": "be several women in the room,” she "
                    },
                    {
                        "data": "said. She indicates she is happy to see "
                    },
                    {
                        "data": "younger people are entering the in- "
                    },
                    {
                        "data": "dustry. “Our industry is made up of a "
                    },
                    {
                        "data": "lot of family businesses and we’re "
                    },
                    {
                        "data": "starting to see the (millennial) sons, "
                    },
                    {
                        "data": "and daughters, taking over, which is "
                    },
                    {
                        "data": "great.” She says the concrete pumping in- "
                    },
                    {
                        "data": "dustry gets in your blood – both be- "
                    },
                    {
                        "data": "cause of the customers and the tight "
                    },
                    {
                        "data": "knit community. Working with heavy "
                    },
                    {
                        "data": "equipment and complex mixing sci- "
                    },
                    {
                        "data": "ence can be challenging depending "
                    },
                    {
                        "data": "on the job, but the work is also re- "
                    },
                    {
                        "data": "warding when you succeed, she said. "
                    },
                    {
                        "data": "Langhauser said the concrete "
                    },
                    {
                        "data": "pumping industry is a great industry "
                    },
                    {
                        "data": "for any woman because of its oppor- "
                    },
                    {
                        "data": "tunities and potential. She has a niece "
                    },
                    {
                        "data": "currently considering her career op- "
                    },

                        "data": "tions. “Construction is an opportunity "
                    },
                    {
                        "data": "often ignored by women but there is "
                    },

                    },

                        "data": "getting started. “We were very "
                    },
                    {
                        "data": "lean, didn’t have many programs, "
                    },
                    {
                        "data": "few members and a small budget. "
                    },
                    {
                        "data": "My role was to implement sys- "
                    },
                    {
                        "data": "tems and processes, to get book- "
                    },
                    {
                        "data": "keeping and so on set up. As we got "
                    },
                    {
                        "data": "organized, I started taking on more "
                    },
                    {
                        "data": "roles. The executive director at the "
                    },
                    {
                        "data": "time was semi-retired and said that if "
                    },
                    {
                        "data": "I was interested in taking over one "
                    },
                    {
                        "data": "day, he would help me along.” "
                    },
                    {
                        "data": "She says he proved an excellent "
                    },
                    {
                        "data": "mentor, teaching her all about the in- "
                    },
                    {
                        "data": "dustry and its people. Gradually, mem- "
                    },
                    {
                        "data": "bership and programs doubled, the "
                    },
                    {
                        "data": "budget grew five-fold and in 2001, "
                    },
                    {
                        "data": "Collins took the helm as executive di- "
                    },

                        "data": "rector. Collins’ take over coincided with "
                    },

                        "data": "other changes that were happening "
                    },
                    {
                        "data": "within the association and she says it "
                    },

                        "data": "was both a challenging and exciting "
                    },

                    },

                        "data": "tially about her relative inexperience "
                    },

                        "data": "with the industry, she said the board "
                    },

                        "data": "was confident in her ability to learn "
                    },

                    },

                    },
